Terms and Conditions

Overview

These Terms of Service (“Terms”) govern your access to and use of the Epic1 Academy game platform and related services (collectively, the “Service”), provided by Epic1 Academy Inc. (“Epic1 Academy”, “we”, “us” or “our”). Please read these Terms carefully. By using our Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

Changes to Terms

We may modify these Terms from time to time and will post updated versions on our website and in the game platform. Changes are effective as of the posting date. Your continued use of the Service constitutes acceptance of the changes. If you do not wish to continue under the new Terms, you must immediately stop using the Service.

Age Requirements

The Service is available only to students who are at least 5 years old, or such other age threshold prescribed under applicable law. By using the Service, you represent you meet these requirements. Students under 18 require parental consent to use the Service.

License Grant

We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service for non-commercial gameplay purposes only, subject to your compliance with these Terms. You do not acquire ownership of any part of the Service. We reserve all rights not expressly granted in these Terms.

Restrictions

You agree you will not do the following:

• Copy, modify, distribute, sell, or lease any part of the Service.
• Reverse engineer, decompile, disassemble, derive source code from, or create derivative works based on the Service.
• Use the Service for any illegal purpose or in violation of any laws.
• Transfer your account or provide access to your account to any third party.
• Harass, threaten, embarrass, or cause distress, unwanted attention, or discomfort to other users.
• Post or communicate any abusive, obscene, offensive, hateful, discriminatory, or inflammatory content.
• Cheat or utilise any unauthorised robot, spider, or other program in connection with the Service.
• Interfere with the operation of the Service or upload anything that may introduce a virus, disrupt, damage, or interfere with the Service.
• Infringe our intellectual property rights or those of third parties.
• Violate the school’s acceptable use policy for technology.

Virtual Currency and Property

The Service may allow you to purchase virtual currency and other virtual property to enhance gameplay. You acknowledge virtual currency and property have no monetary value and do not constitute real property or actual currency. Virtual currency and property may be consumed, modified, lose functionality, or expire. We have the right to manage, modify, suspend, revoke, or eliminate virtual currency or property as reasonably needed to improve gameplay balance and provide an optimal user experience.

User Content

You are responsible for your content. You grant us a perpetual, royalty-free license to use, copy, modify, distribute, publish, and process user content solely to operate, improve, and provide the Service.

Monitoring

We may monitor and record gameplay, chat logs, and other user interactions to enforce our policies and acceptable use standards. Use of cheating tools, bots, or third party software that interacts with the Service is prohibited.

Disclaimer of Warranties

The service is provided on an “as is” and “as available” basis. We disclaim all warranties, express or implied, including the warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Liability

We will not be liable to you for any indirect, incidental, special, consequential or punitive damages arising from your use of the service. Our maximum liability to you for any damages shall not exceed $50.

Indemnification

You agree to defend, indemnify, and hold harmless Epic1 Academy, its affiliates, directors, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of another person or entity.

Termination

We reserve the right to suspend or terminate your account if you breach these Terms or violate our policies. You may terminate your account at any time by ceasing use of the Service. The following sections will survive termination: Restrictions, Disclaimer of Warranties, Limitation of Liability, Indemnification, and General Terms.

Governing Law

These Terms shall be governed by the laws of Luxembourg without regard to conflict of law principles. 

Dispute Resolution

Any dispute arising from these Terms or your use of the Service will be resolved through binding individual arbitration. Arbitration will take place in Luxembourg.

General Terms

These Terms constitute the entire agreement between you and Epic1 Academy. We may assign these Terms. If any provision of these Terms is deemed invalid, the remaining provisions will remain in effect. Any waiver of our rights under these Terms must be express and in writing. Section titles are for convenience only. “We” refers to Epic1 Academy alone, and never to the combination of you and us.
